Since the parties had conducted themselves the same way for years, it was hard to challenge the other side’s conduct and enforce the terms of the contract. The agreement matched our client’s position, but the parties’ conduct over the years did not. After reviewing all the facts, we decided that because possession of the property was critical to that transport company, and the agreement supported our client, we would file an eviction claim against it for breach of the agreement.

Because possession of the property was critical to the other side, it was unwilling to take the risk of eviction. Immediately after the eviction claim was filed, a settlement was signed in which the other side undertook to comply with the agreement to the letter and promised not to raise any argument about past conduct. A few months later, the tenant fell back into its old ways and breached the agreement, but this time the arguments about past conduct were no longer open to it, and we filed another eviction claim.

Many thanks to Adv. Violeta Shibersky, who managed and led the case together with Adv. Chen Levavi of our firm. We are proud of our firm’s next generation, who apply the art of precision we believe in until the goal set at the outset is reached.
